Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Bazrly website, applications, and related services (collectively, the "Platform").

By creating an account, signing in, or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

Bazrly provides marketplace infrastructure that enables independent shop owners, marketplace administrators, couriers, and buyers to interact. Unless we explicitly state otherwise, we are not the seller of products listed by shops and we are not a party to transactions between buyers and sellers.

Shop owners are responsible for their listings, pricing, fulfilment, and compliance with applicable laws. Marketplace administrators may set rules for marketplaces they operate on the Platform.

You must be at least 18 years old and able to enter into a binding contract to use the Platform.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly if you suspect unauthorised access.

We may suspend or terminate accounts that violate these Terms, applicable law, or platform policies, or that pose a security or fraud risk.

You agree not to:

Access to certain roles (such as shop owner, marketplace administrator, or courier) may require an application and approval. We and relevant marketplace administrators may approve or reject applications at our discretion.

Information you submit in applications must be accurate and kept up to date. We may verify documents and business details you provide.

When you purchase from a shop, you enter into a contract with that shop subject to its listing terms and any applicable marketplace rules.

Payments may be processed through third-party payment gateways. You agree to their terms in addition to ours where applicable.

Delivery, returns, refunds, and disputes are handled according to shop policies, marketplace rules, and applicable law. Platform tools may assist with communication and resolution but do not replace your legal rights against the relevant party.

Shop owners and other participants may be subject to subscription plans, commissions, promotions, or other fees described when you subscribe or use paid features.

Fees, billing cycles, and cancellation terms are shown at the point of purchase or in your account. Failure to pay applicable fees may result in suspension of paid features.

You retain ownership of content you submit, but grant us a non-exclusive licence to host, display, and use that content as needed to operate the Platform.

Bazrly names, logos, software, and design elements are our property or our licensors' property and may not be used without permission.

If you believe content on the Platform infringes your rights, contact us with sufficient detail for us to review the claim.

Our collection and use of personal information is described in our Privacy Policy. By using the Platform, you acknowledge that policy.

The Platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation, or that listings, prices, or third-party services will meet your expectations.

We are not responsible for the conduct of users, shop owners, couriers, or third-party service providers, except as required by applicable law.

To the fullest extent permitted by applicable law, neither Bazrly nor its directors, employees, or affiliates will be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Platform.

Our total liability for any claim relating to the Platform will not exceed the greater of the fees you paid us in the twelve months before the claim or ZAR 1,000, except where liability cannot be limited under applicable law.

You agree to indemnify and hold harmless Bazrly and its affiliates from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, your breach of these Terms, or your violation of any law or third-party rights.

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.

You agree to the exclusive jurisdiction of the courts of South Africa for disputes arising from these Terms, subject to any mandatory consumer protections that apply to you.

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms, except where further consent is required by law.
